Understanding Oklahoma Personal Injury Laws

When pursuing a personal injury claim in Oklahoma, it's crucial to understand the state laws that may impact your case. These laws can affect your ability to file a claim, the amount of compensation you can recover, and how the fault is determined.

Statute of Limitations: How long do I have to file an injury lawsuit?

In Oklahoma, the statute of limitations for most personal injury claims is two years from the date of the injury or accident. If you fail to file your lawsuit within this time frame, you may be barred from seeking compensation for your injuries.

Comparative Negligence Rule & Shared Fault for Accident

Oklahoma follows a modified comparative negligence rule, meaning fault can be apportioned among the parties involved in an accident. Under this rule, a plaintiff’s recovery may be reduced by the percentage of fault attributed to them. However, if the plaintiff is found to be 50% or more at fault, they are barred from recovering any compensation.

Damage Caps in Oklahoma

Oklahoma does not currently have any damage caps for personal injury claims. This means that plaintiffs can recover the full amount of their economic damages, such as medical expenses and lost wages, and non-economic damages, such as pain and suffering.

Proving Negligence in Your Oklahoma Personal Injury Case

Negligence is the foundation of most personal injury cases in Oklahoma. To recover compensation for your injuries, you must prove that the other party's negligence caused your harm.

To prove negligence, you must establish four key elements:

  1. Duty of Care: The defendant owed you a legal duty to act with reasonable care.
  2. Breach of Duty: The defendant breached their duty of care by acting or failing to act in a way that a reasonably prudent person would under similar circumstances.
  3. Causation: The defendant’s breach of duty directly caused your injuries.
  4. Damages: You suffered actual harm, such as physical injuries, medical expenses, lost wages, or property damage, due to the defendant’s negligence.

At Hasbrook & Hasbrook, we have the knowledge, resources, and experience to build strong cases and prove negligence. Our attorneys will:

  1. Thoroughly investigate your accident to gather evidence
  2. Work with experts to analyze the cause of your accident and the extent of your injuries
  3. Handle all communication with insurance companies and the defendant’s legal team
  4. Negotiate aggressively for a fair settlement or take your case to trial if necessary

We employ several strategies to ensure the best possible outcome for your case, such as:

  • Utilizing cutting-edge case management software to organize documents and track deadlines
  • Assigning dedicated teams to each case to ensure personalized attention
  • Leveraging technology to streamline communication and document sharing with clients
  • Maintaining a network of trusted experts to provide prompt and reliable support
  • Conducting thorough initial investigations to identify all potential sources of compensation
  • Engaging in proactive communication with clients, keeping you informed, and promptly responding to your questions and concerns

By working more on the case, we can provide our clients with the highest quality of legal representation while moving their cases forward as efficiently as possible. We firmly believe this detailed work improves settlement offers.

Damages & Compensation Available in Oklahoma Accident Claims

You may be entitled to various damages (compensation) for your losses when you've been injured due to someone else's negligence. At Hasbrook & Hasbrook, our Oklahoma City personal injury attorneys fight tirelessly to maximize your compensation and ensure you receive what you deserve.

Economic Damages

Economic damages are intended to compensate you for the quantifiable financial losses you’ve incurred due to your injury. These may include medical expenses, lost wages, and property damage.

Non-Economic Damages

Non-economic damages are intended to compensate you for the intangible losses you’ve suffered due to your injury. These may include pain and suffering, emotional distress, and loss of enjoyment of life.

Punitive Damages

The court may award punitive damages in rare cases where the defendant’s actions were particularly egregious or intentional. These damages are intended to punish the defendant and deter similar behavior in the future.

Several factors can influence the compensation you may receive for your personal injury claim, including the severity of your injuries, the extent of your medical treatment, and the impact of your injuries on your ability to work and enjoy life.

At Hasbrook & Hasbrook, we understand a serious injury’s profound impact on your life. We fight aggressively to maximize your compensation and ensure you receive what you deserve. Our attorneys will work closely with medical and economic experts to ensure that your current and future needs are accurately projected and included in your claim.

How Our Oklahoma City Personal Injury Lawyers Deal with Insurance Companies

After an accident, dealing with insurance companies can be one of the most stressful and challenging aspects of your personal injury claim. Insurance adjusters are trained to protect their company’s bottom line, often minimizing payouts to injured claimants.

Insurance companies use various tactics to minimize the amount they have to pay out on personal injury claims, such as offering quick, low settlements, disputing the severity of your injuries, or shifting blame onto you.

If an insurance adjuster contacts you after an accident, you must be cautious about what you say. Provide only basic information, don’t give a recorded statement without consulting an attorney, and don’t discuss your injuries in detail or speculate about their severity.

At Hasbrook & Hasbrook, our personal injury attorneys have extensive experience negotiating with insurance companies. We can handle all communications, gather evidence to support your claim, calculate damages, and negotiate aggressively to secure a fair settlement.

Consult an experienced personal injury attorney before accepting any settlement offer from an insurance company. An attorney can evaluate the offer and advise whether covering your current and future damages is fair and adequate. Contacting our attorneys is free, and we’ll give you an honest evaluation of your case, including if you need a lawyer.

What to Expect During Your Personal Injury Claims & Lawsuit Process

We understand that pursuing a personal injury claim can be daunting and unfamiliar. Our experienced Oklahoma City personal injury lawyers are here to guide you through every step of your case, keeping you informed and involved while working tirelessly to achieve the best possible outcome.

While each personal injury case is unique, most follow a similar process:

1.

Seeking Medical Attention

The first step after sustaining an injury should always be to seek medical attention. Not only is this vital for your health, but medical records will play a crucial role in your claim, providing evidence of your injuries and their impact on your life.

2.

Initial Consultation with Your Personal Injury Lawyer:

After you receive prompt medical care, your first step in protecting your claim will be meeting with your personal injury lawyer, often during a free consultation. They’ll review your case details and plan the next steps. An experienced lawyer can offer you a comprehensive understanding of your legal rights and the potential worth of your claim. They will handle negotiations with insurance companies and guide you through the legal process, allowing you to focus on your recovery.

3.

Investigation, Documentation, and Evidence Gathering:

Your lawyer will start a thorough investigation of your case. They gather evidence, go to and investigate the accident scene, request medical records & bills, and witness testimonies to support your claim.

This puts personal injury cases in the best position for maximum compensation.

4.

Medical Assessments:

Your attorneys will begin working on your case immediately.

This includes contacting the insurance companies, gathering evidence, interviewing witnesses, and compiling the Demand Packet.

5.

Dealing with the Insurance Company:

Expect your lawyer to handle all communications with the insurance company. They will negotiate on your behalf attempting to secure financial compensation without going to court.

Before proceeding to a lawsuit, most attorneys file a claim with the at-fault party’s insurance company. Your attorney will prepare and submit a demand letter outlining the details of your case, the extent of your injuries, and the compensation you are owed. This includes copies of the relevant medical documents and proof of lost income.

Negotiations with the insurance company will then begin. It’s up to the client’s preference, but we recommend waiting two weeks to follow up with the adjuster.

6.

File a Lawsuit:

If a settlement cannot be reached, the next step is to file a lawsuit. This involves preparing legal documents to start the court process formally. The defendant will be able to respond, and the case will proceed through various stages, including discovery, pre-trial motions, and possibly a trial.

Some cases settlement immediately after a lawsuit is filed. Most insurance companies have a different adjuster assigned to the claim once the suit is filed. This adjuster generally has more “settlement authority” than the initial claims handler.

Under Oklahoma Law, the defendant has 20 days to file an Answer after being served the lawsuit. The insurance company lawyers will file an Answer, then “issue discovery” to the Plaintiff.

7.

Discovery Phase:

Both parties in the lawsuit will exchange information during the discovery phase. This can include answering written questions (“interrogatories”), producing documents (“requests for production”), and requests for admissions. Depositions start shortly after the discovery responses have been made.

8.

Mediation and Negotiation:

Before going to trial, there’s often a mediation process where both sides try to reach an agreement. Most judges in Oklahoma City require a mediation.

A mediator is a “neutral third party” that facilitates communication between the parties to try to find a dollar amount that is agreeable to both sides. The mediator is paid by each side of the case, whether it is settled or not.

Each party will be at the mediator’s office but in separate rooms, with the mediator going back and forth. However, more and more local mediators are conducting mediation via Zoom. The setup is the same, but each party is in a separate “breakout room.”

Most cases (75+%) that go to mediation settle. Cases that don’t settle are generally caused by one of two reasons:

  1. The parties did not have all of the facts, so the valuations from both sides were too far apart. So, it was too early to mediate. If this happens, the case has a strong chance of settling at a second mediation after additional depositions have occurred.
  2. One or both sides have missevaluated what the case is worth. This type of case is headed to a trial.
9.

Trial:

The case will go to trial if a settlement cannot be reached. Your lawyer will present your case in court, arguing in front of a judge or jury. The goal is to secure a judgment in your favor, granting you the financial compensation you deserve.

Most personal injury trials in Oklahoma City are tried before a jury, but both sides can agree to a “bench trial” where the judge decides the case.

At Hasbrook & Hasbrook, we believe in keeping our clients informed and involved throughout their cases. We will provide regular updates on the status of your case, explain legal concepts and procedures in plain language, and be available to answer your questions and address your concerns.

What to Do After a Personal Injury Accident in Oklahoma City

In the aftermath of a personal injury accident, the steps you take can significantly impact your health, well-being, and the success of your legal claim. At Hasbrook & Hasbrook, our experienced Oklahoma City personal injury lawyers are here to guide you through this challenging time and ensure you take the right actions to protect your rights.

Seeking Medical Attention

Your health and safety should be your top priority after an accident. Even if you don’t think you’ve been seriously injured, seeking medical attention as soon as possible is essential. Prompt medical care ensures that you receive the treatment you need and creates a record of your injuries that can be valuable evidence in your legal claim.

Avoid Common Mistakes

In addition to seeking medical attention and gathering evidence, it’s crucial to avoid common mistakes that can harm your personal injury claim. Some of these mistakes include:

  • Admitting fault: Or apologizing for the accident can be used against you by the insurance company.
  • Unnecessary Recorded Statements: Giving a recorded statement to the insurance company without consulting your attorney can be used to undermine your claim.
  • Inconsistent Medical Treatment: Failing to follow through with medical treatment or missing doctor’s appointments can be interpreted as a sign that your injuries are not as serious as you claim.
  • Social Media: Posting about the accident or your injuries on social media, as the insurance company, can use this information to dispute your claim.
  • Low-Ball Offers: Consult an attorney before accepting a settlement offer, as initial offers are often much lower than the actual value of your claim.

Gathering Evidence and Documentation

Try to gather evidence at the scene of the accident, such as photos of the accident scene, your injuries, and any property damage, as well as the contact information of any witnesses. This evidence can be crucial in establishing liability and proving the extent of your damages. Use your cell phone camera to document as much information as possible.

Contacting a Personal Injury Lawyer

After an accident, contact an experienced personal injury lawyer as soon as possible is in your best interest. An attorney can advise you on your legal rights and options, handle communications with insurance companies, investigate your accident, calculate your damages, and negotiate a fair settlement.

Person wondering in front of laptop

A personal injury lawsuit is a legal action initiated by someone who has been injured due to someone else’s negligence or intentional act.

The time limit, or statute of limitations, for commencing a personal injury lawsuit varies by state but typically ranges from one to four years from the date of the injury.

Yes, you can still sue if you were partially at fault, but your compensation may be decreased by your percentage of fault in many jurisdictions.

You can recover economic damages for healthcase expenses and lost wages, non-economic damages for pain and suffering, and sometimes punitive damages for particularly egregious conduct.

While not required, hiring a personal injury lawyer significantly increases your chances of securing fair compensation.

Most personal injury lawyers work on a contingency fee basis, meaning they only get paid if you win your case, typically taking a percentage of the settlement or judgment.

Thank you Hasbrook & Hasbrook for your excellent service. A special thanks to Clay, you were great. The attorneys world needs more people like you. Thank you.

Bryon Lakins

I couldn’t be happier with Clayton. He’s actually the second attorney I hired on my case. The first law firm had my case for a year and then said ‘here’s your settlement, we recommend it, and it’s all we can get you, but take it or leave it, this is a good settlement for your type of small case.’ It was barely anything. After parting ways with that law firm, I hired Clayton about a week or two later. He worked on my case more in one month than the previous law firm and was able to settle my case for close to 2x what the earlier law firm could do. He also charged less than what the other firm wanted….25 vs 40%. So, I was very happy with the result and to finally get my case over with – so frustrating!

C.M

Keep up the great work…they rocked.
